TELAAH KRITIS ATAS PEMIKIRAN GERAKAN GENDER VERSUS REALITAS GENDER DALAM PANDANGAN FIQIH

Abstract

Some Islamic Laws that have been running for centuries and have become the agreement of all schools and ijma' of the scholars lately seem to be facing trials for review. A number of modern scholars who call themselves as religious harmonizers with contemporary contexts have emerged with the theme of reconstructing Islamic law, starting to inspire some of these Islamic Fiqh laws. In the name of justice, gender equality, equal rights, anti-discrimination and marginalization are values ​​that have been raised as the spirit of propaganda in campaigning to criticize several Islamic Fiqh laws that have been established among Muslims for centuries. Some of the texts of the Qur'an that were agreed upon by qath'i by the scholars began to be sued to be something that is not qath'i anymore as a matter that can still be debated again. For them, none of the texts are qath'i because all the texts of the Qur'an and hadith can still be reinterpreted according to the principles of logical justice. The principle of God's justice which is interpreted according to them as contained in real life which is anti-discrimination must be harmonized according to reason and logic, in this case Islam no longer means surrender, and faith is no longer a total belief in all God's laws revealed to humans.
