WEWENANG PEJABAT PEMBUAT AKTA TANAH (PPAT) DALAM MEMBUAT AKTA HAK MILIK ATAS TANAH BAGI WARGA NEGARA INDONESIA (WNI) NON PRIBUMI DI DAERAH ISTIMEWA YOGYAKARTA

Abstract

Abstract  : The type of research used in this research is juridical-normative with a statutory approach and a conceptual approach Legal materials in this research are primary sources of law, secondary sources of law, tertiary sources of law, which are collected by using library research techniques (literature study) and analyzed using prescriptive techniques. Instruksi Wakil Kepala Daerah DIY NO. K.898/I/A/1975 limits the authority of the Notary and PPAT in making land deeds for non-Indigenous Indonesians. Notaries and PPAT have been given the authority to make land deeds for all Indonesian citizens equally regardless of non-Indigenous or Indigenous Indonesians. But Instruksi Wakil Kepala Daerah DIY NO. K.898/I/A/1975 even placed limits on that authority. Law Impact from Instruksi Wakil Kepala Daerah DIY NO. K.898/I/A/1975 to Notary and PPAT and can be related with the theory of justice and legal certainty where in Instruksi Wakil Kepala Daerah DIY NO. K.898/I/A/1975 does not guarantee legal certainty because it does not comply with the theory of legal certainty in the theory of Lon Fuller (1971) say a law contain 8 (eight) principles to be said to have met the principle of legal certainty, one of which is "Not contradicting with other laws and regulations". Beside Instruksi Wakil Kepala Daerah DIY NO. K.898/I/A/1975 also not representing a sense of justice and not fulfill the principle of justice as described by John Rawls (1971), one of which is the equality of treatment in every opportunity. Instruksi Wakil Kepala Daerah DIY NO. K.898/I/A/1975 Should be erased and not enforced so as not to limit authority of Notary and PPAT Instruksi Wakil Kepala Daerah DIY NO.
