Abstract            The aims of the study were to investigate to what extent the essence of waiver of costumary land in Merauke Regency and to investigate to what extent the release of customary land can provide legal certainty for investors. The results of the research indicate that the waiver of customary land is the claim of the existence of indigenous people as a condition of the transfer of land rights in Papua Province especially in Merauke Regancy. The release of customary land for investors benefit in Merauke Regency does not provide legal certainty for investors, so it causes the conflict of land affair. The conflict occurs due to the overlapping of tenure or claim by some tribes over the land rights and land boundaries which are not clear because they are natural boundaries.Keyword : The Release of Customary Land, Investment AbstrakPenelitian ini bertujuan untuk mengetahui bagaimana esensi pelepasan tanah adat di Kabupaten Merauke dan sejauhmana pelepasan adat dapat memberikan kepastian hukum terhadap investor. Hasil penelitian ini menunjukkan bahwa esensi pelepasan tanah adat dalam literatur hukum adat dikenalnya sifat kedalam dan keluar, dalam hal ini penguasaan hak tanah dalam bentuk recognitie dan untuk recognitie itu bermuara pada kesejahteraan masyarakat adat setempat serta untuk kemaslahatan seluruh umat yang ada di Kabupaten Merauke. Pelepasan tanah adat untuk kepentingan investasi di Kabupaten Merauke ternyata tidak memberikan kepastian hukum terhadap investor sehingga menimbulkan konflik pertanahan. Konflik terjadi karena adanya ketumpangtindihan penguasaan atau pengakuan oleh beberapa suku atas hak ulayat dan batas-batas tanah yang tidak jelas karena merupakan batas alam.Kata kunci : Pelepasan Tanah Adat, Investasi
