Prospek Pengaturan Organisasi Masyarakat Dalam Transisi Demokrasi

Abstract

AbstrakDemokrasi tanpa organisasi masyarakat sebagai komponen masyarakat sipil (civil society) adalah kemusykilan. Sebab, demokrasi memerlukan partisipasi politik. Partisipasi dapat diorganisir dalam kelembagaan seperti organisasi masyarakat (ormas) dan bisa pula masing- masing individu. Hal ini dijamin secara konstitusional dalam Pasal 28 UUD 1945. Selama ini, pengaturan organisasi masyarakat berinduk pada Undang-Undang Nomor 8 Tahun1985 tentang Organisasi Kemasyarakatan. Dipastikan, undang-undang dimaksud bukan saja tidak sesuai lagi dengan kebutuhan masyarakat melainkan dibentuk dalam suasana watak otoritarian sehingga penggantiannya merupakan keniscayaan. Kini, Dewan Perwakilan Rakyat (DPR) RI telah mengusulkan inisiatif Rancangan Undang- Undang tentang Organisasi Masyarakat (RUU- Ormas). Dalam kerangka demikian, menarik dicermati bagaimana model ormas yang sebaiknya didorong di masa depan dan diatur dalam undang-undang ormas. Bagaimana pula desain ormas yang hendak dibentuk bila dikaitkan dengan kontekstualisasi transisi demokrasi, sebuah fase yang tidak mudah dipastikan dilalui tanpa pelembagaan dan penguatan mentalitas demokrasi yang substansial.Kata Kunci: Undang-undang, Demokrasi, Organisasi, Masyarakat. AbstractDemocracy without community organizations as a component of civil society is impossible. Because, democracy requires political participation. Participation can be organized in institutions such as community organizations (CSOs) and can also be each individual. This is guaranteed constitutionally in Article 28 of the 1945 Constitution. So far, the regulation of community organizations is based on Law Number 8 Year1985 about Community Organizations. Certainly, the said law is not only no longer in accordance with the needs of the community but was formed in an atmosphere of authoritarian character so that its replacement is a necessity. Now, the House of Representatives (DPR) of the Republic of Indonesia has proposed a Draft Law on Community Organizations (Draft Ormas). Within this framework, it is interesting to look at how the model of CSOs should be encouraged in the future and regulated in CSO laws. What is the design of CSOs to be formed when it is related to the contextualization of the democratic transition, a phase that cannot be easily ascertained without institutionalization and strengthening of a substantial democratic mentality.Keywords: Law, Democracy, Organization, Society.
