KEWENANGAN MAHKAMAH KONSTITUSI MENGUJI PERATURAN PEMERINTAH PENGGANTI UNDANG-UNDANG/PERPPU
Abstract
AbstrakSecara normatif, Putusan Mahkamah Konstitusi Nomor 138/PUU-VII/2009 mengandung konsekuensi dua hal. Pertama, perlindungan hukum terhadap Perppu yang dinilai bertentangan dengan konstitusi dapat menempuh dua jalur yaitu diuji di MK atau melalui DPR dengan mekanisme persetujuan Perppu pada masa sidang berikutnya. Kedua, Putusan MK di atas berdampak perluasan kewenangan MK yang diatur di dalam Pasal 24 C UUD 1945 yaitu tidak hanya menguji Undang-Undang terhadap Undang-Undang Dasar, namun juga Perppu terhadap Undang-Undang Dasar. Dengan demikian, terdapat perluasan kewenangan melalui putusan MK. Meski demikian, secara akademis, penulis tetap berpendapat, seharusnya Perppu hanya dapat diuji melalui political review atau legislative review oleh DPR sesuai dengan kewenangan yang diberikan Pasal 22 UUD 1945. Hal ini tidak saja selaras dengan penafsiran gramatikal konstitusi melainkan juga merawat koherensi sistem konstitusional sehingga tidak menimbulkan kompleksitas persoalan ketatanegaraan baru. First, legal protection against Perppu which is considered to be in conflict with the constitution can take two paths, namely being tested in the Constitutional Court or through the House of Representatives with the approval mechanism of the Perppu in the next session. Secondly, the Constitutional Court's decision above has an impact on the expansion of the Constitutional Court's authority as regulated in Article 24C of the 1945 Constitution, namely not only testing the Law on the Basic Law, but also Perppu on the Basic Law. Thus, there is an expansion of authority through the Constitutional Court's decision. Nevertheless, academically, the author still believes that the Perppu should only be tested through political review or legislative review by the DPR in accordance with the authority granted by Article 22 of the 1945 Constitution. This is not only in line with the grammatical interpretation of the constitution but also maintains the coherence of the constitutional system so that it does not raises the complexity of new constitutional issues.Keywords: Perppu, Constitutional Court, Authority, Testing.
