PERSPEKTIF HUKUM ISLAM TENTANG KONSEP CHILDFREE DALAM PERNIKAHAN
Abstract
This research is motivated by the existence of childfree thinking which seems to contradict Islamic Family Law and human nature as a living being who is blessed with a sense of love for various pleasures, including love for children. Childfree has become a controversy in Indonesia because it is considered contrary to the thinking of Indonesian people who mostly believe that the purpose of marriage is to have children. The purpose of this study is to analyze the perspective of Islamic law on the concept of childfree in marriage. The results of this study conclude that childfree or what is commonly called Voluntary Childlessness, where a person voluntarily does not want to have children, this condition is different from Involuntary Childlessness, where a couple who has not been blessed with a child and the couple wishes to have children or is forced not to have children, in the state of someone who does not have children based on voluntary choice. The current trend of choosing not to have children in marriage is interesting because for whatever reason it contradicts the purpose of marriage as recommended in the Qur'anic verses. One way to optimize the presence of children is by spacing the birth of children and not to reject the presence of children and choose childfree. Childfree is likened to 'azl because it is substantially the same as the childfree option in that both reject the presence of children before they have the potential to exist, sexual intercourse between husband and wife is the most likely cause of someone experiencing pregnancy. This research has theoretical benefits in order to provide benefits in the form of increasing Islamic knowledge, especially in matters relating to the law of marriage decisions without having children according to Islamic law for Muslims. Meanwhile, the practical benefit is a theoretical understanding in order to be able to address the phenomenon of childlessness in the surrounding environment wisely without justifying one's own arguments and considering other people's arguments wrong.
