Relevansi Essensial Hak Manusia dan al Maqâshid al Syarî‘ah
Abstract
It has long been true that the human rights context has been known in Islamic Shari'a, but with different terminology. So, it is not uncommon to miss the perception that Islamic Shari'a does not adopt human rights values, and even in some cases is considered to be contrary to the universal values of human rights. In this condition it is necessary to make efforts to rectify what constitutes the misunderstanding by explaining the existence of an inseparable relationship between the fulfillment of human rights in Islamic law.
