Landasan Konstitusional tentang Pengaturan Perkawinan Beda Agama dalam Undang-Undang Perkawinan Menurut Putusan Mahkamah Konstitusi
Abstract
This study is to understand the constitutional basis for the formalization of Islamic law, especially the prohibition of interfaith marriages in the Marriage Law. The research uses library data and qualitative analysis. The results of the study show that there are five principles that must be considered in the formalization of Islamic law related to the ideology of the Indonesian state, the limitation and regulation of the constitutional rights of citizens, religious values which are the norms of legislation, marriage as an outer and inner relationship based on the Almighty God. One and religion as the foundation of national and state life based on Pancasila and the 1945 Constitution.
