Abstract
Persoalan pencatatan nikah bagi masyarakat muslim di Indonesia, terus menjadi agenda diskusi di kalangan pemerintah, akademisi, ulama dan masyarakat tentang kedudukannya dalam hukum perkawinan. Jika ditelusuri dari referensi-referensi klasik dari pandangan ulama mazhab, pencatatan nikah tidak ditemukan. Akan tetapi jika ditelusuri dari ketentuan perundang-undang yang berlaku di Indonesia, maka pencatatan nikah tersebut menjadi kewajiban melalui perintah Undang-undang nomor 1 tahun 1974 tentang perkawinan serta Kompilasi Hukum Islam (KHI). Hal ini menjadi persoalan tersendiri dalam penerapannya bagi masyarakat yang sangat kuat memegang fikih mazhab. Artikel ini, mencoba menengahi persoalan tersebut dengan menawarkan teori Maqashid al-Syari’ah sebagai pisau analisisnya, sehingga terlihat sejauhmana ketentuan pencatatan nikah yang diatur menurut peraturan perundang-undangan tersebut dapat diklaim sebagai produk hukum Islam secara metodologis.
